Who We Are
Based Stream Tools is provided by Actuator Digital Pty Ltd (ABN 44 617 792 293), registered in Queensland, Australia.

1. Acceptance of Terms
By accessing and using Based Stream Tools ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Description of Service
Based Stream Tools is a platform that provides streaming tools and services to content creators, including but not limited to chat overlays, leaderboards, goal trackers, and AI-powered moderation features.
3. Beta Terms
Certain features are offered as Beta/Preview. Beta features may be incomplete and may change or be discontinued at any time. Data loss may occur; do not rely on Beta for critical workflows. Feedback you provide may be used to improve the Service without obligation to you.
4. User Accounts
To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
- You must provide accurate and complete information when creating an account
- You are responsible for keeping your account credentials secure
- You must notify us immediately of any unauthorized use of your account
- You must be at least 13 years old to create an account (if under 18, parental consent required)
- One account per user; account sharing is prohibited
- You must have verified ownership of any streaming channels you connect to the Service
- Your account age must be consistent with the connected platform's minimum age requirements
5. Billing & Subscriptions
Fees & Billing: Some features require a paid subscription ("Plan"). By starting a Plan you authorize us to charge the applicable fees and taxes to your payment method on a recurring basis until cancellation.
Auto-Renewal: Plans renew automatically for the same term unless you cancel before the current term ends.
Cancellation: You may cancel anytime, effective at the end of the current billing cycle; you retain access until then.
Refunds: Except where required by law, fees are non-refundable. If we materially breach these Terms and fail to cure within 30 days, you may request a pro-rata refund of prepaid, unused fees.
Trials & Discounts: Trials convert to paid Plans unless canceled before the trial ends. Partner codes apply as stated.
Taxes: Fees exclude taxes; you are responsible for applicable taxes.
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Distribute spam, malware, or other harmful content
- Attempt to gain unauthorized access to our systems
- Use the Service for any illegal or unauthorized purpose
- Harass, abuse, or harm other users
- Reverse engineer or attempt to extract source code
- Scrape, spider, or use automated means outside documented APIs
- Circumvent quotas, rate limits, or access controls
- Impersonate others or misrepresent affiliation
- Engage in harassment, hate speech, or promotion of illegal activity
- Violate platform community guidelines (Twitch, YouTube, etc.)
- Use the Service for gambling or lotteries unless permitted by law and platform rules
7. Third-Party Platforms
The Service integrates with platforms and tools (e.g., Twitch, YouTube, OBS). We are not affiliated with or endorsed by them. You must comply with their terms and understand their APIs, scopes, and rate limits may change or be interrupted without notice. We are not liable for such changes or outages.
8. Content, Intellectual Property & Publicity Rights
Your Content: You retain ownership of content (including overlays, graphics, usernames, avatars, stream footage).
License to Provide the Service: You grant us a non-exclusive, worldwide, royalty-free license solely to operate and improve the Service, including hosting, processing, transmitting, displaying, and creating non-public derivatives needed for functionality. We do not sell your content.
Publicity: With your permission (you can toggle this in Settings or by emailing support), you grant us a limited license to use your name, handle, avatar, logo, and non-sensitive stream screenshots to identify you as a user of the Service (e.g., website "Used by" grid, testimonials). You may withdraw this permission at any time; we will cease new uses within 10 days.
Takedowns: We honor DMCA/APS notices. Report alleged infringement to: basedstreamtools@gmail.com with required details.
All intellectual property rights in the Service and its original content remain the property of Based Stream Tools and its licensors.
9. Privacy
Our Privacy Policy explains what we collect, why, and how we handle it, including analytics, cookies, and email communications. By using the Service, you consent to our data practices described there. We may send you service-related emails and, with your consent, marketing communications about new features and updates.
10. Termination
We may suspend or terminate for cause (e.g., violation of Acceptable Use). Where reasonably possible, we will provide notice and an opportunity to cure. Upon termination by us without cause, we will provide a pro-rata refund of prepaid, unused fees and a 30-day window to export your data.
11. Disclaimers and Limitation of Liability
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties.
To the fullest extent permitted by law, our total liability for any claim in any 12-month period will not exceed the fees you paid to us for the Service in that period. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
Consumer Law: Nothing in these Terms excludes, restricts, or modifies any consumer rights that cannot be excluded under Australian Consumer Law or other applicable consumer protection laws.
12. Changes to Terms
We may update these Terms and the Service from time to time. For material changes, we will provide 30 days' prior notice via email to your account email and/or in-product notice. For pricing changes, we will provide 30 days' prior notice.
13. Governing Law
These Terms and any non-contractual obligations are governed by the laws of Queensland, Australia. The courts located in Queensland shall have exclusive jurisdiction.
